Article 1 (Purpose)
These Terms set out the rights, duties and responsibilities between users and 4rest (the "Operator"), the publisher that runs the film magazine 5ft magazine (the "Site"), in connection with the use of the Site.
Article 2 (Definitions)
- Site: all pages and services provided on the 5ft magazine domain (www.5ftmag.com)
- User: anyone who visits the Site to view articles, photos, listings and other content
- Member: a user who signs in with a Google account to use member features such as photo submissions, Market listings and favorites
- Editors: staff given separate permissions by the Operator to review content and run the Site
- Content: all material posted on the Site, including articles, photos, film information, listings and comments
Article 3 (Effect and Changes of These Terms)
These Terms take effect when posted on the Site. The Operator may revise them when necessary and will announce revisions on the Site at least 7 days before they take effect (30 days for changes that are unfavorable to users or significant). If you keep using the Site after the effective date, you are deemed to have agreed to the revised Terms.
Article 4 (Services)
- Viewing content such as magazine articles, photos and the film catalog
- Reading the free webzine and paid e-books
- Member photo submissions (Reader's Roll), published after review by the Editors
- Posting and viewing listings in the member-to-member secondhand Market
- Managing your own collection with likes and saves
- Community features such as comments and reports
Article 5 (Membership and Accounts)
- Membership is created through Google OAuth sign-in. There is no separate sign-up step or password.
- Members are responsible for all activity on their own accounts.
- The Operator may limit, suspend or terminate membership in the following cases:
- Using another person's information or photos without permission
- Violating these Terms or applicable law
- Disrupting the operation of the Site or harming other users
Article 6 (Photo Submissions and Publishing Rights)
- Copyright in photos a member submits to the Site remains with that member.
- By submitting a photo, the member grants the Operator, free of charge, a non-exclusive license to use the photo within the following scope:
- Publication on the Site (www.5ftmag.com) and the Operator's official social media
- Inclusion in the printed 5ft magazine (with prior notice)
- Use in promotional material for the Site and the magazine
- The Editors review photos and may approve or decline them, and may refuse to publish in the following cases:
- Photos that infringe the copyright, portrait rights or other rights of others
- Photos containing hateful, violent or sexual content
- Photos that do not fit the identity of the magazine
- Members may withdraw (delete) their submitted photos at any time from the member page (/me.html). Photos already printed and distributed in the paper magazine cannot be withdrawn.
Article 7 (Using the Secondhand Market)
- The Site's Market is a space for displaying listings for direct deals between members. The Operator is not a party to any transaction.
- All responsibility for payment, shipping, refunds and other aspects of a transaction lies with the buyer and seller.
- The following items may not be listed. If found, the Operator may hide or delete them at its discretion:
- Stolen goods, counterfeits and illegally modified items
- Copyright-infringing material, obscene material and adult products
- Firearms, explosives and other items whose sale is restricted by law
- Items unrelated to the nature of the magazine
- Members who find an inappropriate listing can alert the Editors with the "Report" feature on the listing page.
Article 8 (User Obligations: Prohibited Conduct)
Users must not:
- Use another person's personal information, photos or works without permission
- Post false information or attempt fraud or deception
- Post hateful, discriminatory, abusive, sexual or violent content
- Send or distribute spam, advertising or malicious code
- Bypass the Site's technical protections or send excessive requests with automated tools
- Do anything else that violates applicable law or these Terms
Article 9 (Limits of the Operator's Liability)
- The Operator does not broker transactions between members through the Site and is not liable for disputes or losses arising from them.
- The Operator is not liable for losses caused by events outside its responsibility, such as natural disasters, telecommunications failures or hacking.
- The Operator is not responsible for the accuracy or legality of content posted by members, and will promptly review any reasonable report.
Article 10 (Changes to or Suspension of Services)
The Operator may change or suspend all or part of the services when necessary for operational or technical reasons, and will announce the reason and date on the Site.
Article 11 (Personal Information)
The collection, use and retention of members' personal information are governed by the separate Privacy Policy.
Article 12 (Disputes and Jurisdiction)
Disputes concerning these Terms or the use of the Site are governed by the laws of the Republic of Korea. The court with jurisdiction over the Operator's place of business (Dong-gu, Gwangju) is the court of first instance.
Article 13 (Paid Services and Reading Passes)
- The Operator sells reading passes for paid e-books (a "Reading Pass"). A Reading Pass is the right to read the e-book on the account that bought it. It is not ownership of a downloadable file.
- Payment can be made by electronic payment on the Site (through a payment provider) or by buying on Naver Smart Store and verifying the order number.
- Prices, payment methods and terms of use are shown on each product page.
- Reading Passes are granted per account and may not be transferred or lent to others. Copying, capturing or distributing paid content, or letting a third party read it, is prohibited.
Article 14 (Withdrawal of Purchase and Refunds)
Withdrawals of purchase and refunds follow the separate Cancellation and Refund Policy. Once you start reading an e-book, your right to withdraw may be limited under Article 17(2) of the Act on the Consumer Protection in Electronic Commerce, etc. This is shown on the purchase screen.
